Terms of Use
These terms are the agreement between you and Brighten Wellness, LLC ("we," "us") for your use of the Bramblr mobile app and the bramblr.app website. We've kept them short and plain on purpose — please read them, especially Section 4 (Bramblr is not medical care).
1. Accepting these terms
By creating a Bramblr account or using the app, you agree to these terms. If you don't agree, please don't use Bramblr. If you're using Bramblr on behalf of someone else (for example, as a parent or guardian), you agree on their behalf and confirm you're allowed to.
2. Who can use Bramblr
You must be at least 13 years old to create an account. Bramblr carries a 12+ rating in app stores, but it is designed for adults — our content assumes an adult audience. If you're under 18, please use Bramblr only with a parent or guardian's permission. Bramblr is not directed to children under 13, and accounts for children under 13 aren't permitted.
3. Your license to use Bramblr
As long as you follow these terms, we give you a personal, non-transferable, revocable license to install and use Bramblr on your devices, for your own personal use. That's the whole deal: it's a license to use the app, not a transfer of ownership.
The app itself — the software, the Bramblr brand and design, and the educational content in it (including the assessment and checkpoint instruments adapted from Dr. Brighten's book) — belongs to us or our licensors. You may not copy, resell, sublicense, or commercially exploit any of it, and you may not reverse-engineer the app except where the law expressly allows it.
4. Bramblr is not medical care
This is the most important section, so it says the important things plainly:
- Bramblr is an educational and self-tracking tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. It does not diagnose, treat, cure, or prevent any condition.
- The content in Bramblr — including insights, tips, and anything adapted from Dr. Brighten's book — is general educational information, not advice for your specific health situation. It cannot consider what a clinician who knows you can.
- Predictions are estimates, not promises. Cycle predictions, fertile-window and ovulation estimates, and pattern summaries are statistical estimates calculated from the data you've logged. They can be wrong — especially when cycles vary, which is common in perimenopause — and they improve only as you log more. Wider estimate windows in the app are the app being honest with you, not an error.
- Do not use Bramblr as contraception. Fertile-window and ovulation estimates are for learning about your cycle only. They are not a method of birth control and must not be relied on to prevent (or achieve) pregnancy.
- Don't change medication, supplements, or treatment based on the app. Always talk with a qualified healthcare provider about your health, and bring them your questions — and your Bramblr data, if it helps you be heard.
- In an emergency, don't open the app — call your local emergency services.
5. Your content
The check-ins, notes, logs, answers, and anything else you write or record in Bramblr are yours — you own your content, and these terms don't change that.
To operate the service, you give us a limited license to host, store, back up, and process your content for the sole purpose of running Bramblr for you: syncing it to your devices, generating your insights and history, and delivering your reminders. That license ends when your account is deleted, and we don't use your content for anything else — we don't sell it, share it, or train machine-learning models on it. How we handle your content is described in our Privacy Policy.
6. Acceptable use
A short list of things we don't allow, to keep Bramblr safe and working for everyone:
- breaking into, probing, or testing the security of the service, or trying to access another user's account or data;
- scraping, harvesting, or mass-downloading any part of the service;
- interfering with or overloading the service or its infrastructure;
- using Bramblr for anything unlawful, or storing unlawful, threatening, or infringing content in your notes;
- impersonating anyone or misrepresenting who you are.
If you violate these terms, we may suspend or disable your account. We'd rather not — please just don't.
7. Payments
There are none. Bramblr is free in this version: no subscriptions, no in-app purchases, and no advertising. If that ever changes, you'll see clear terms and pricing before you're asked to pay for anything.
8. Availability and warranties
We work to keep Bramblr reliable, but we provide it on an "as is" and "as available" basis. We can't promise it will be uninterrupted, timely, or error-free, and we don't guarantee that any particular feature — or any prediction or estimate — will always be available or accurate. Beyond what the law requires, we make no warranties about the app, and we don't waive anything the law says we can't waive.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data arising from your use of Bramblr. Because Bramblr is provided free of charge, our aggregate liability for anything connected to the app is limited to the maximum extent permitted by law. Nothing in these terms limits protections that the law of your country or state doesn't allow us to limit — including your data-protection rights under the GDPR or CCPA, which are addressed in our Privacy Policy.
10. Ending things
You can stop using Bramblr any time, for any reason. You can also delete your account from the Settings screen in the app — that erases your account and your content, as described in the Privacy Policy. You're welcome back any time, but a deleted account means starting fresh.
We may disable or terminate accounts that violate these terms, or in the rare case we need to discontinue part of the service. Sections 3, 4, 5 (as to prior use), 8, 9, and 12 survive after your account ends.
11. Changes to these terms
If we make material changes to these terms, we'll notify you in the app or by email before they take effect, and the effective date at the top will update. If you keep using Bramblr after that date, you're accepting the updated terms. If a change to how health data is processed is involved, we'll ask for consent again rather than assume it.
12. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules, and any dispute will be resolved in the courts located in Florida. This doesn't override any mandatory consumer or data-protection rights you have where you live — those always apply.
